According to the Announcement No. 39 of 2023 issued by the Ministry of Commerce and the General Administration of Customs, high-purity, high-strength and high-density artificial graphite materials and their products, as well as natural flake graphite and its products and other graphite parts fall under dual-use items. Relevant licensing procedures need to be completed when they are exported. The specific process is as follows: 2

1. Prepare application materials: Export operators need to fill out the application form for the export of dual-use items and technologies, and prepare the following documents

1. The original or a copy or scanned copy consistent with the original of the export contract or agreement.

2. Technical description or test report of the items to be exported.

3. Proof of end user and end use.

4. Introduction of importers and end users.

5. Identity proofs of the legal representative, main business manager and handler of the applicant.

2. Submit an application: by the Ministry of Commerce business system unified platform dual-use items and technology import and export control electronic business application (https://ecomp.mofcom.gov.cn) to upload the application materials, and will be the end-user and end-use certificate original and the dual-use items export license application form submitted to the competent commerce departments at the provincial level.

3. Reporting by provincial-level commerce authorities: Each provincial-level commerce authority shall report the electronic materials and necessary paper materials submitted by enterprises to the Ministry of Commerce.

4. Review by the Ministry of Commerce: After receiving the license application, the Ministry of Commerce conducts a review or reviews it in conjunction with relevant departments. When necessary, report to The State Council for approval.

5. Obtaining the License: After the application for the export of dual-use items has been reviewed and approved, the approval data will be transferred to the provincial-level competent department of commerce. The provincial-level competent department of commerce will issue the approval form for the export of dual-use items. The enterprise can collect the "Export License for Dual-Use Items" at its location with the approval form.

6. Customs declaration for export: Enterprises shall handle customs declaration procedures with the customs based on the "Export License for Dual-Use Items", and the customs shall handle the release procedures based on the export license issued by the Ministry of Commerce.

In addition, export operators can check the approval progress in real time in the application of dual-use items and technology import and export control business on the unified platform of the Ministry of Commerce's business system. If it is necessary to change key elements such as the type of dual-use item, the destination country and region for export, etc. during the validity period of the license, a new application for the export license of dual-use items shall be made in accordance with the regulations. If other non-critical elements are to be changed, an application for alteration should be submitted to the competent department of commerce under The State Council.
